BASIC TERMS AND CONDITIONS

These are our basic terms and conditions. Your agreement with us may have additional terms. Do not agree to do business with Election Day Strategies if you do not agree 100% with our terms and conditions. If you have any questions, call us at 888-726-2020 during our hours of operation.
- We do not give refunds or credits, even if you decide to drop out of the race, do not qualify for your race, missed the filing deadline, changed your mind, found a different provider, incur any adverse life situation, sickness or even if you die. This is for many reasons, but primarily because our work is consulting, research, design and strategy based. Once we provide that service, we cannot take it back. Additionally, we work fast which means once you sign up and pay us, we pay the people who are working on your services and we immediately purchase whatever we need to for your campaign.
- Any changes to the scope of our agreement or services contracted will result in additional fees.
- Election Day Strategies is not a fundraising company. We do not recommend the use of third party fundraising companies because they have not proven to be effective. We do not recommend the use of third party fundraising lists.
- If you decide to change parties or change offices during the campaign, we reserve the right to refuse. You may also incur additional charges, as we will have to change everything over to reflect your new status. Your changing of your campaign does not entitle you to a refund of any of our services.
- Termination – We reserve the right to terminate our agreement or services for non-payment, non-compliance, abandonment of the campaign, or if any payment is canceled, returned, threats of charge backs or an actual charge back, or if any legal action arises from this agreement. You may be held liable for attorney and legal fees resulting from that action.
- Our normal office hours are 8:00am until 5:00pm central time. We are available Monday thru Friday. We do not take client calls on weekends or federal holidays (in most cases). This does NOT mean we are not working, this means we do not take calls during those hours.
- We understand that texting is convenient for most, but you are running for office and we need to make sure that our communications are secure. Cell phone communications can be intercepted, phones can get lost and they can be easy to access by a number of people. Furthermore, it is not a good format for us to be able to track communications thruout the company since cell phones are the personal devices of employees or contractors. With limited exceptions, we do not do business by text. Please call our business line at 888-726-2020 during business hours or send us an email to info@electiondaystrategies.com any time.
- We reserve the right to charge an extra fee for clients who habitually call/text us after hours.
- If your account with us is NOT in good standing, we are not required or obligated to provide you with any further services, advice or assistance with your campaign.
- When we ask you to provide us with something whether that is a bio, a headshot, issues information or anything else, we are expecting you to do this right away. Your failure to do so will definitely delay the service that you receive, as we have all clients on a work schedule so we can keep things running smoothly and on time for everyone. We will not delay or reschedule another client’s services because you were not able to get us your information on time.
- Campaign Phone Service/Phone Number – Some accounts include a leased campaign phone number and phone answering by us. The client does not own that phone number. Oftentimes those phone numbers are non-transferable. The phone number will be active until your first election (primary or general). If you wish to keep it longer, you will be billed a monthly rate.
- Website Services – The websites we build for our clients are hosted on our servers because of privacy and security issues, with our software and apps that we have a license for. You do not own the server, the software or the apps, although you DO own the website itself. We do not manage or maintain any website that is not hosted on our servers. Our website prices include the SSL certificate, the design, the framework, the SEO, email, etc., for a predetermined amount of time, usually until the election. For the period of time, we handle the maintenance and security. We generally do not allow our clients to have access to our servers, and here is why: the majority of our clients are not skilled website designers and while yes, clients could easily go in and change text or maybe even some images, they do not know how everything is all connected in the backend. When clients “break” their websites, they expect us to fix it. If this happens, we will fix it (if we can find the error), but there will be a minimum charge of $500.00 no matter how small the fix is. If a client decides to move their website to another provider, that website will no longer be maintained by us and no refund or proration will be provided. Furthermore, if a client decides to move their website, we cannot guarantee that all the website related services will still be operational or that the website will look the same. We are not responsible for this.
- The Candidate agrees that he/she has read this entire agreement, agrees with the scope of our services and our pricing, and has asked any relevant questions related to this agreement before signing. The candidate fully understands that we do not provide refunds, credits or prorations.
- Choice of Law and Venue – Election Day Strategies LLC is located in Bexar County Texas. The validity, interpretation, construction, and performance of this agreement and terms shall be governed by the laws of the State of Texas (excluding any that mandate the use of another jurisdiction’s laws). Any action to enforce or for breach of this agreement shall be brought exclusively in the state or federal courts of Texas in Bexar County, and/or City of San Antonio.
- Due to the nature of political campaigns, ELECTION DAY STRATEGIES does not guarantee, imply, or otherwise suggest that a favorable outcome for your campaign is inevitable.
